Terms of Service & Disclaimer

1. Nature of services
Innershift offers NLP-based life coaching, which may include guided meditation and hypnotic-style relaxation techniques to support personal goals. Sessions are delivered in person or online, and are educational, motivational, and aimed at vocational and avocational self-improvement within the meaning of California Business and Professions Code §2908.
These services are not psychotherapy, psychology, psychiatric care, clinical hypnotherapy, mental-health counseling, or medical treatment, and they are not a substitute for any of those. The techniques used are not clinical hypnosis and are not offered for the diagnosis or treatment of any emotional, psychological, or medical condition.
Martina is a Certified NLP Practitioner. She is not a state-licensed mental-health professional, psychologist, psychotherapist, marriage and family therapist (LMFT), licensed professional clinical counselor (LPCC), or licensed clinical social worker (LCSW), and she does not hold a license issued by the California Board of Behavioral Sciences or the Board of Psychology. Words such as "therapy," "therapist," "counseling," or "treatment" are not used to describe her work.
2. No medical or psychological claims
Sessions are not intended to diagnose, treat, cure, or prevent any disease, mental illness, or psychological disorder. Nothing said or done in a session should be interpreted as medical advice. If you have, or suspect you have, a medical or mental-health condition, please consult a qualified licensed practitioner.
Do not stop, reduce, or change any prescribed medication or treatment without first consulting your doctor or qualified healthcare provider.
3. Suitability & disclosures
Although the techniques used are gentle (NLP coaching, guided meditation, and hypnotic-style relaxation rather than clinical hypnosis), some practices — particularly deep relaxation and visualization — are not appropriate for everyone. Please disclose any of the following before booking, and consult a qualified licensed practitioner before participating, if you have or have had:
- Psychosis, schizophrenia, or other severe psychiatric disorders
- Active suicidal ideation or recent self-harm
- Severe clinical depression or untreated bipolar disorder
- Epilepsy or a history of seizures
- Dissociative identity disorder or severe dissociation
- Active substance dependence or are under the influence at the time of the session
- Pregnancy complications or other significant medical conditions
In such cases, please seek care from a qualified licensed medical or mental-health professional. Martina reserves the right to decline or end services if she believes another form of care would better serve you.
4. Client responsibilities & informed consent
By booking a session, you confirm that:
- You are at least 18 years old (or have parental/guardian consent if a minor)
- You are voluntarily participating and have the capacity to give informed consent
- You have honestly disclosed any relevant medical, psychiatric, or psychological history
- You understand that results vary from person to person and are not guaranteed
- You take full responsibility for your own decisions, choices, and actions before, during, and after sessions
5. No guarantee of results
NLP-based life coaching is a collaborative process. Outcomes depend on many factors, including your engagement, openness, life circumstances, and the work you do between sessions. No specific result, outcome, or timeline is guaranteed, and any examples or testimonials shared are illustrative — not promises of similar results.
6. Confidentiality
Sessions are confidential. Martina will not share information about you or the content of your sessions without your written consent, except where:
- Required by law, court order, or lawful regulatory request
- There is a credible risk of imminent serious harm to you or another person
- Necessary to seek professional or legal advice (in which case identifying details are minimized)
Note: confidentiality between a coach and client does not carry the same legal privilege as that between a licensed psychotherapist and patient under California law. If legally protected privilege matters to you, please work with a state-licensed mental-health professional.
7. Recordings & intellectual property
Sessions may be recorded only with mutual written agreement. Where Martina provides a meditation or relaxation recording, audio, worksheet, or other materials, those remain her intellectual property and are licensed to you for personal, non-commercial use only. They may not be copied, redistributed, resold, or shared without prior written permission.
Clients may not record sessions without Martina's prior written consent.
8. Booking, payment & cancellations
Payment
Sessions and packages are payable in advance unless otherwise agreed in writing. Prices are quoted at the time of booking.
Cancellation & rescheduling
We ask for at least 24 hours' notice for cancellations or rescheduling. Sessions cancelled with less than 24 hours' notice, or missed without notice ("no-shows"), may be charged in full at Martina's discretion.
Refunds
Single sessions are non-refundable once delivered. Unused sessions in a package may be refunded on a case-by-case basis, less an administrative fee, where genuine hardship or clinical contraindication applies.
9. Online sessions & technology
Online sessions are conducted via secure video-conferencing tools. While reasonable steps are taken to protect your privacy, no online platform is fully immune to interception, outage, or third-party access. By participating in an online session you accept the limitations of the technology used.
Please join online sessions from a quiet, private space. Never participate in guided meditation, hypnotic-style relaxation, or any visualization exercise while driving, operating machinery, or in any situation that requires your full attention.
10. Limitation of liability
To the maximum extent permitted by applicable law, Innershift and Martina shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the services. Total liability for any direct claim shall not exceed the amount you paid for the specific session(s) giving rise to the claim.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
11. Changes to these terms
These terms may be updated from time to time. The version in effect when you book a session is the version that applies to that session. The "Last updated" date above will always reflect the current version.
12. Governing law
These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute arising from these terms or from the services will be resolved exclusively in the state or federal courts located in California. Where a less formal resolution is possible, both parties agree to attempt good-faith dialogue first.
